Terms and Conditions
National Roads and Motorists’ Association Limited ABN 77 000 010 506 (”NRMA” or “we”) has opened website based forums, blogs, on-line polls and video recordings for people to provide feedback and comments on a range of issues relating to the NRMA Roadtube website (collectively, “Forums”). You can visit the Forums by going to www.roadtube.com.au.
Please be aware that by posting to the Forums you are agreeing to our terms and conditions below.

1. Conditions of Use
1.1 Your use of the Forums is governed by these terms and conditions (“Terms”).
1.2 By participating in and continuing to use the Forums, you agree to be bound by these Terms. If you object to any provision in these Terms, you must not participate or continue to use the Forums.
2. NRMA’s Rights
2.1 All copies of user contributed material, including text, images, photos and videos (“Material”), become the property of NRMA.
2.2 NRMA reserves the right to do any of the following at its sole discretion:
a) select Material to be posted on the Forums;
b) remove any Material on the Forums at any time;
c) amend, alter, reproduce (in part or in its entirety) in any form of media, edit or delete any Material you submit without any right of attribution to you and to pass it on to any other entity;
d) use any photos or videos submitted as Material; and
e) terminate your access to the Forums if we believe you have breached the Terms.
2.3 NRMA retains the right at all times to monitor, retain or disclose any Material posted on the Forums as necessary to satisfy any applicable law, regulation, legal process or governmental request.
3. Your Obligations
3.1 In submitting Material, you:
a) warrant that any Material you submit is your own work and that you own all intellectual property rights in it; and
b) warrant that any Material you submit for publication or which is published on the Forums is not obscene, defamatory, offensive, or otherwise illegal.
3.2 You must not:
a) post any Material on the Forums:
i. that is not original Material in which you own copyright;
ii. which infringes the intellectual property rights of any third party;
iii. that contains information that helps sell, buy, advertise, promote, solicit or offer any goods or services, shares or other commodities, third party websites, competitions, schemes or any other matter (including phone numbers, mail or email addresses or URLs);
iv. that contains personal information, or the personal details of third parties such as phone numbers, mail or email addresses;
v. that is offensive, abusive, obscene, defamatory, threatening, indecent or which is sexual or pornographic in nature;
vi. that contains gratuitous swearing, profanity or spiteful remarks;
vii. that is unlawful, makes reference to, or provides links to illegal activities (including but not limited to insider trading, ramping/hyping stocks, defamation, vilification, pornography, racial or sexual slurs or drug use);
viii. that vilifies, insults or humiliates any person on the basis of race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability;
ix. that contains false, misleading or deceptive information or misinformation or rumour;
x. that you do not have a right to post because of any law or arising out of a contractual obligation;
xi. that impersonates any other person or entity;
xii. that contains viruses, or other malicious code, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware.
b) engage in spamming, flaming, typing in ALL CAPS, or any other hostile activity in relation to the Forums.
4. Liability for Material
4.1 Any opinions expressed in Material posted on the Forums are not and are not in any way represented as being the opinions of NRMA or its related bodies corporate
4.2 NRMA:
a) is not responsible for, and does not accept any liability in respect of, any Material posted on the Forums; and
b) does not check the content or accuracy of any such Material.
5. Disclaimers
5.1 The Material contained on the Forums is for general discussion purposes only. You should not rely on any Material contained on the Forums and we accept no responsibility or liability whatsoever for any loss or damage you may suffer as a result or your reliance on any Material posted on the Forums. You should make your own enquiries and take independent advice tailored to your specific circumstance prior to making any decisions. Your use of the Forums is at your sole risk.
5.2 We make no representations or warranties:
a) in relation to any of the Material on the Forums (including any warranties as to the quality, accuracy, completeness or fitness for any particular purpose of such Material);
b) that the Material is virus free. You should take your own precautions in this respect and we accept no responsibility for any malicious code that may be introduced into your system by using the Forums.
6. Access
Although we will do our best to provide constant, uninterrupted access to the Forums, we cannot and do not guarantee this and accept no responsibility or liability for any interruption or delay.
7. Liability and Indemnity
7.1 Certain State and Commonwealth legislation, including the Trade Practices Act 1974 (Cth), imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. These Terms do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory provisions.
7.2 You will indemnify us if we suffer any loss or damage or incur any costs in connection with your breach of these Terms or any other legal obligation by you or your use of or conduct on the Forums.
7.3 You agree that in no circumstances will we be liable to you for any indirect, incidental, special and/or consequential losses or damages (including any loss of profits) in connection with:
a) the use of or access to, or any inability to use or access, the Forums or any Material on the Forums;
b) unauthorised access to or alterations of your transmissions or data; or
c) statements or conduct of any third party on the Forums.
8. General
8.1 These Terms may be varied from time to time. You will be notified of any changes here.
8.2 In addition to these Terms which govern the use of the Forums, NRMA’s General Conditions govern the use of the web site.
8.3 These Terms will be governed by and construed in accordance with the laws of the state of New South Wales, Australia.
